Kiefer Sutherland may surrender to police today to answer assault charges filed by fashion designer Jack McCullough, who says the actor head-butted him at a nightclub in a Lower Manhattan hotel on Monday night.

The altercation allegedly happened  at an after-party for the Metropolitan Museum Costume Institute gala, where Sutherland was spotted in a tuxedo.

McCullough, with a cut on his nose, told police that he was walking through a packed crowd at Submercer in the Mercer Hotel when he wiggled his way between Sutherland and Brooke Shields. Sutherland, who plays Jack Bauer on the hit show "24," was talking to the actress, and apparently felt that McCullough was invading their space. When Sutherland asked McCullough to give them some room, McCullough reportedly shot back with a smug answer that angered the star, known for having a drinking problem.

Sutherland, already on probation for a 2007 drunk-driving arrest, has not been arrested in this latest claim, but could face misdemeanor assault charges when he surrenders. Investigators also plan to speak to Shields for more details about the night. Officials said that McCullough refused medical treatment at the time he filed the complaint.

Poor, poor misguided Kiefer.  Quite possibly McCullough was partially at fault.  But, really, have you not had enough trouble already Kiefer?  Sometimes it takes the bigger man to just walk away…

I agree Deena, but it must be so frustrating when people think that they can toss their nasty comments around with no consequences…often just to provoke stars.  I definately object to the crass behavior of the McCullough’s of the world and the paparazzi for thinking they somehow have a right to butt into the lives of stars.  So, McCullough grow up, take the bump on your nose and go home.  Learn to behave and keep your opinions to yourself!!!

No, there is no excuse for rudeness either.  I have very little use for the paparazzi.  McCullough does not fall into that catagory, but still…  But Kiefer Sutherland has had trouble before and really needs to keep his nose clean.  It’s quite possible that McCullough baited him for that very reason.

Here! Here Dana! These guys have to learn to behave themselves in public. This is where I am so sad the old studio system isn’t in place. If Clark Gable did this to say Robert Young, there would have been suspensions and jail time.
