Iowa Supreme Court Approves Same-Sex Marriage

Millions of Americans are celebrating today after Iowa’s Supreme Court unanimously ruled that excluding gays and lesbians from marriage violates the state’s constitution.

Read the ruling, "The Iowa statute limiting civil marriage to a union between a man and a woman violates the equal protection clause of the Iowa Constitution."

The decision upheld a lower court’s ruling and makes Iowa the first Midwestern state to extend marriage rights to same-sex couples. Obviously gay activists are thrilled. This could help spark a change across the country, said former Bill Clinton adviser Richard Socarides:

I think it’s significant because Iowa is considered a Midwest sate in the mainstream of American thought. Unlike states on the coasts, there’s nothing more American than Iowa. As they say during the presidential caucuses, ‘As Iowa goes, so goes the nation.’

Gay marriage won’t go into effect immediately, of course, and won’t become law until the lower court approves it, according to the final conclusion: "The district court properly granted summary judgment to plaintiffs. Iowa Code section 595.2 violates the equal protection provision of the Iowa
Constitution. Our decision becomes effective upon issuance of procedendo." Still, this is a watershed moment for middle America, and one that will spark intense debate. So, readers, what are your thoughts on the Iowa decision?

I think it is great — it makes no sense to deny anyone the opportunity to be married, should that be what they choose (although I don’t necessarily recommend it).  :)

Iowa approved same sex marriage, I almost fell out of my chair when I read that.  Hope it stays on the books and good for one of our Midwestern states for going for it.

Awesome!  Now we need to have the CA Supreme Court Rule Prop 8 Unconstitutional.

We are not a Democracy.  A Democracy is "Mob Rule."  We are a Federal Constitutional Republic.  That means we elect a Representative and that Representative makes laws with strict adherance to the Constitution.  Ridiculous Propositions like Prop 8 violate the Constitution by usurping the power of the Republic with Mob Rule.  Mob Rule will always tread on the Minority and it is why the United States of America is not now nor has it ever been a Democracy.

Now let’s all be Patriotic Americans and stop legislating and legalizing hatred with silly Anti-Equality Amendments.

I am confident that eventually the Supreme Court will rule that denying the right to marry to gay people is unconstitutional. Don’t know how long it will take, but it will happen.

Surprising for a midwestern state but this is a good thing.  Any person who wants can get married in this country, why not gays and lesbians?  Way to go Iowa.
