Judge Who Jailed Judith Miller Given New Spy Court Gig

Supreme Court Justice John Roberts yesterday appointed two new judges to the Foreign Intelligence Surveillance Court — and both are sure to be controversial. First, there’s Thomas F. Hogan, the judge who jailed journalist Judith Miller after Miller refused to reveal who told her that Valerie Plame was a CIA spy. That source was eventually revealed to be Dick Cheney’s chief of staff, Scooter Libby. Though reporters’ sources are typically protected, Hogan claimed that Miller’s refusal to name Libby could be mistaken for "obstruction of justice." Miller served 85 days in jail.
Roberts’s second pick? Judge Susan Webber Wright, an Arkansas judge who dismissed Paula Jones’s sexual harassment suit against President Bill Clinton. Later, during the Whitewater investigation, Wright jailed a witness, Susan McDougal, who refused to say whether Clinton lied about his failed real estate investments.
Both Hogan and Wright will serve for seven years at the Foreign Intelligence Surveillance Court, which orders surveillance on potential foreign threats inside the United States. Raw Story reports that Hogan had the FBI search the DC offices of former Rep. William Jefferson back in 2006, the first time there has been such a raid in American history.
