Melissa Huckaby could face the death penalty if found guilty of kidnapping, raping and murdering 8-year-old Sandra Cantu.

The 28-year-old Sunday school teacher from Tracy, CA, was in tears during her brief time before the judge yesterday, her first court appearance since her arrest. Security was tight, and there was a phalanx of press at the hearing. Members of the Cantu and Huckaby families sat on opposite sides of the courtroom, the LA Times reports, with some of Sandra’s supporters wearing T-shirts with her picture.

Huckaby, whose hands and feet were chained, was charged with murder with the special circumstances of kidnapping, rape with a foreign object and lewd or lascivious conduct with a child. She did not enter a plea. So far, the district attorney hasn’t decided whether to seek the death penalty, but it is an option, given the gravity of the charges she faces; life without parole is another option.

Huckaby has already undergone mental evaluation for a previous theft conviction, noted District Attorney James Willett, adding, "obviously any mental issues will have an effect on this case." Huckaby’s public defender asked for another medical evaluation. Huckaby’s arraignment will continue April 24. Sandra and Huckaby’s families have been asked to not talk to the media about the case anymore.

Meanwhile, KCRA-TV learned that Huckaby claims Sandra’s murder was "an accident." The TV station also reports that another search warrant was executed upon Huckaby’s home, because she admitted writing a note with the street names of where Sandra’s body was found.

Sandra’s body was discovered stuffed in a suitcase that was thrown into an irrigation pond near her Tracy mobile-home park. She was last seen on her way to Huckaby’s house, to play with her 5-year-old daughter. It’s thought that Sandra was raped and killed in the nearby church in which Huckaby’s family runs.

Of course mental issues come into play! No person in his or her right mind would do something so horrible. Will we ever truly know why she did this?

Why is it always an accident?

I am against the Death Penalty.  During voir dire for a Capital case I asked to approach the bench.  I told the Judge that I cannot be an impartial juror because to me Murder is Murder is Murder.  It does not matter if it is ordered on the street or in this fancy room.  She accepted my position and excused me.

However, if this young woman is guilty of these crimes, that are impossible for me to wrap my mind around, then  I think I could actually stomach an exception to my position on the Death Penalty for her.

Rebecca, this poor little girl didn’t have a chance…this is just too sad to even comprehend…she will probably plead insanity and there will probably not even be a trial….this is one case I don’t want to even hear updates on TV….it’s just too too sad!

I know.  It’s been really big news here in the Bay Area.  When first learned about the suitcase I just cried and cried.  How can anyone hurt a child?

I am just wondering what more is to come?  Who else is involved.  It seems more news is about to come out.  Seems like everyday we get a new story and a new update and a new shocking bit of information about this sick and twisted story.

I am against the Death Penalty, but like I said if she, and anyone anyone else, is guilty of this crime, I think I’d make an acception to my position just for them.  Fry Em!

Rebecca…couldn’t agree with you more…I don’t know what is happening these last few months with the killing of children, seems like every month a child is missing or killed or both…..it breaks my heart…so innocent and no chance to defend themselves at all…..there are some sick people out there….they cannot be rehabilitated, and they are no good to society….I say "Fry EM"…just like you.

For a long while I was against the death penalty. In the past few years I’ve changed my mind.

I imagine a lot more about this woman will be revealed in due time. Whether she truly has a mental condition that would cause her to do this will come to light.

As someone mentioned earlier………someone should check on her poor daughter.

My heart goes out to the Cantu family.

Being for the death penalty or against it has nothing to do with this case at this point and time. Why does our society always jump way ahead of ourselves? The real point of discussion is did she do it and what exactly is she guilty of. There is so much to the story that we do not know, and until the evidence and facts of the case are revealed we should be outraged for what has happened to Sandra Cantu, but stop short of condemning the accused. In his interview with ABC, Dr. Michael Welner makes a very good point that we should be mindful of - http://abcnews.go.com/video/playerIndex?id=7331296

What conclusions can we as a society draw when we are so uninformed? – None!!!!
