Man Sues McDonald's After Nude Photos of His Wife Appear Online

Did the Ronald McDonald clown do it?

An Arkansas couple has filed a suit against the fast-food chain McDonald’s after nude photographs of the wife reportedly surfaced on the Internet, the suit states. Phillip Sherman accidentally left his cell phone (which contained nude photographs of his wife on it) at the Golden Arches restaurant. According to the suit, Sherman was told that employees were holding on to the phone until he returned to pick it up.

The Sherman’s are suing McDonald’s Corp, the franchise owner and store manager for $3 million in damages.

The moral of the story: Store "personal" photographs someplace safe.

Message to Phillip Sherman: In a perfect world, even fast food employees that earn minimum wage would look upon their jobs with a level of importance and professionalism that if you left a personal item in their restaurant you would be assurded it would be watched after in a secure manner until it was retrieved. But this is 2008 and (I’m generalizing) most fast food workers are working there to earn a paycheck, no more and no less. Your privacy, comfort and possessions are of little import to them and legally (speaking as someone who knows) you are about to get a wake up call. Your lawsuit is going to fall on deaf ears and you are going to learn that this is a new day and age and it was/is your responsibility to keep personal and intimate images and data in a secure manner so that the general public doesn’t have acces to it. Mr. Sherman essentially walked into a McDonalds with a folder that contained nude photos of his wife, left it there. Employees opened the folder, looked at the pictures and then did as they wanted with them. Now Mr. Sherman is balking that they saw the photos and had access to them. If he had not left them there they would not have had access to them to do any and all that they have done. It was Mr. Sherman that started this unfortunate ball rolling, and the court is going to take that into consideration. This is an incident that should be a cautionary tale for everyone in regard to what we store on our cell phones and PDAs.

Ronald McDonald is freaky?? Who knew!! Seriously though, Mr. Sherman is responsible for his own carelessness. It’s about time that Americans stop bogging the legal system down with issues for which we are personally responsible and/or have no legal merit. Mr. Sherman, if I were McDonald’s, I’d be suing you for being frivolous and immature. And if I were Mrs. Sherman, I’d be filing papers in another kind of court.

Amazing! If I lost my phone, I doubt if anybody could crack my password to even look at the thing… they’d have to just completely erase it to even use it. Beyond that, it’s her fault for letting him have nude pictures of herself, his fault for carrying them around on an unlocked electronic device, and totally his fault for being an idiot… I hope a judge tosses this to the dumper immediately.

When are people going to learn that if you put nude pictures of yourself anywhere that could possibly be seen by someone, they will be? And why did he need the pictures on his phone in the first place, couldn’t he wait til he got home to see her in person? This is a family problem, not a family restaurant problem. If they win the case people will be leaving naked pictures everywhere, that should be interesting.

Well, what about his rights to have personal stuff without the world getting to see it all? If someone is looking for a phone number to call this guy, it is one thing… but, to snoop into his pictures, I think is just wrong, especially if they are misusing the pics. What it seems to me is that many are advocating what our current p.Resident is doing to us… eavesdropping, snooping, and using it against us, at will. If someone found the stuff, and they intended to return it, they should have respected the personal data and kept it to themselves. Whatever happened to honor? If, on the other hand they found it, snooped, and decided to post it, print it, whichever, then they should never have called the guy to return it. They should have simply thrown it out, or put it somewhere for him to find it on his own. Then, let him do whatever he will. Ignorance is not a defense. I believe he is within his rights to stop them from abusing his privacy rights, as well as collecting for “damages” to he and his wife for character assassination. The wife should be able to sue as well, because she is the one who is truly innocent in the matter after-the-fact. Just another opinion…
